Welcome to Instxnt. These Terms of Service ("Terms") govern your use of the Instxnt website and services (the "Service") operated by FROM AMERICA LLC (the "Company"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Using the Service

Instxnt provides tools for creating and publishing simple storefronts. You are responsible for your account, any content you publish, and for complying with applicable laws when using the Service. You must be at least 13 years old to use the Service.

2. Accounts

To access certain features you must create an account. Keep your account credentials secure. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.

3. Payments and Stripe

Payments processed through the Service are handled by Stripe. By purchasing through Instxnt you agree to the payment processor's terms as well as these Terms. The platform may collect fees and, if applicable, distribute funds to connected sellers using Stripe Connect. See our documentation for details.

4. Intellectual Property

The Service and its original content (excluding content you provide) are the exclusive property of the Company and are protected by copyright, trademark, and other laws.

5. Prohibited Conduct

You must not use the Service for illegal activities, infringe third-party rights, distribute malware, or otherwise misuse the Service. We reserve the right to remove content or suspend accounts that violate these Terms.

6. Termination

We may terminate or suspend access to the Service at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. IN NO EVENT WILL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

8. Indemnity

You agree to indemnify and hold the Company harmless from any claims, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

9. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice (for example, via email or on the Service). Continued use after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the jurisdiction where the Company is incorporated, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within that jurisdiction.
